The ‘Duty to Manage Asbestos’ from the Control of Asbestos Regulations 2012 do not normally apply to domestic premises, however the requirements do apply to the communal parts of these premises. Examples of communal areas would include communal corridors, foyers, lifts, shafts, staircases, boiler houses, vertical risers, gardens, yards and outhouses.

Is it a legal requirement?

Yes, the duty holder legally has to manage the asbestos in the building and make sure that no one is exposed to asbestos fibres. Once the initial asbestos survey has taken place and the asbestos identified, the asbestos must be managed, maintained and inspected suitable intervals.
